SC dismisses appeal by “Wele Suda”, death sentence stands

The Supreme Court today dismissed a special leave to appeal application filed by convicted drug trafficker Gampola Vidanage Samantha Kumara, known as “Wele Suda”, thereby upholding the death sentence imposed on him by the Colombo High Court.

A three-judge bench comprising Justices Mahinda Samayawardhena, Arjuna Obeyesekere, and Sobhitha Rajakaruna refused to grant leave to appeal against earlier rulings of the lower courts.

With today’s decision, the conviction and death sentence remain in force.

“Wele Suda” was sentenced to death by the Colombo High Court on October 14, 2015, after being found guilty of possession and trafficking of 7.05 grams of heroin in Mount Lavinia in 2008.

The original High Court judgment was delivered by then High Court Judge, now Chief Justice Preethi Padman Surasena.

The Court of Appeal later affirmed both the conviction and the sentence on April 5, 2019.

In his appeal to the Supreme Court, Kumara had challenged the legality of the judgments delivered by both the High Court and the Court of Appeal, but the apex court declined to intervene, bringing the long-running case to its current legal conclusion.
