Ruling that the police officers had conducted a vexatious and frivolous prosecution causing severe distress to a citizen, the Magistrate delivered a sharp critique of the department's performance metrics. He remarked that if senior police officials continue to dictate orders demanding that subordinates file more cases next month than they did in the current month, Sri Lanka's population would not be sufficient to sustain police prosecutions within the next five years.
Emphasizing that a rising case count is actually a reflection of the inefficiency of the area's police force, Magistrate Bandula Gunaratne directed the Court Registrar to forward an official copy of this judicial order directly to the Inspector General of Police (IGP) for review.
The victim of this malicious prosecution was identified as Chamara Chathuranga Marasinghe, a resident of Makandana in Dewalapola. The Magistrate fully acquitted Marasinghe of both cases that had been filed against him by the Gampaha Corruption Eradication Division.
Concluding the verdict, the Magistrate held the arresting police officers of the unit alongside the Police Department collectively liable, ordering them to pay the designated financial compensation to the acquitted citizen for the damages caused by their misconduct.
