Supreme Court to hear Shani's FR petition

The Supreme Court has granted leave to proceed with the Fundamental Rights (FR) petition filed by former CID Director SSP Shani Abeysekara challenging the National Police Commission’s decision to interdict him from police service following the 2019 Presidential Election.

A three-judge bench of the Supreme Court, comprising Justices Vijith Malalgoda, Kumuduni Wickremasinghe, and Mahinda Samayawardena, granted leave to proceed based on alleged violations of Fundamental Rights guaranteed under Article 12(1) and 14(1)(g) of the Constitution.

Shani Abeysekara, the petitioner, stated that just four days after the release of the Presidential Election results on November 21, 2019, he received a message informing him of his transfer as the Personal Assistant to the Deputy Inspector General of Police, Galle Range. He noted this as an unprecedented move within the Sri Lanka Police hierarchy.

The petitioner highlighted his lack of awareness regarding the reason for his transfer, deeming it unjustified. The National Police Commission's directive on January 7, 2020, to interdict him further exacerbated the situation.

Shani Abeysekara is seeking Rs. 10 million in compensation for the alleged violation of his Fundamental Rights. The respondents include former IGP Chandana Wickremaratne, members of the National Police Commission, Chairman of the National Election Commission, Defence Ministry Secretary, and others.

President's Counsel Saliya Pieris, instructed by Attorney-at-law Manjula Balasooriya, represents Shani Abeysekara in this case.
