The case involves allegations that the youths were abducted, unlawfully detained, and held for ransom. Earlier, action had been taken to release Wijegunaratne from the case following instructions from the Attorney General.
However, the latest court order comes after a petition filed by the aggrieved parties challenging that decision. The Magistrate stated that the request of the victims could not be dismissed, particularly in light of the evidence presented.
The court further emphasized that a Magistrate is not bound to follow the Attorney General’s instructions and highlighted the significant responsibility of the Attorney General in ensuring justice.
The Magistrate also noted that the previous decision to release the suspect based on the Attorney General’s advice, despite the presence of evidence, was flawed.
Authorities have been instructed to prepare a fresh charge sheet and present the case before court on June 10. The Magistrate expressed confidence that the Attorney General would extend support in the upcoming legal proceedings.
