The Attorney General today informed the Court of Appeal that if the need arises to arrest former Parliamentarian Udaya Gammanpila over his alleged offensive remarks, the court will be duly notified through a formal motion.
The statement was made by Deputy Solicitor General Sudarshana de Silva, who appeared on behalf of the Criminal Investigation Department (CID) during the hearing of a writ petition filed by Gammanpila.
At a previous hearing, the CID told the Court of Appeal that no decision had been made regarding his arrest in connection with the matter.
In his petition, Gammanpila stated that on August 27, 2025, several media outlets reported that the CID had informed the Colombo Fort Magistrate’s Court of an ongoing investigation into whether his remarks amounted to an offence under Section 3(1) of the ICCPR Act No. 56 of 2007 and Section 120 of the Penal Code, which relates to inciting or attempting to incite feelings of disaffection towards the State.
The Court of Appeal will continue to monitor developments as the investigation proceeds.
