The order was issued by Colombo Fort Magistrate Nilupuli Lankapura, who noted that the complainant had failed to appear before court despite being served with two notices.
Withanage was the second suspect in the case, while the first suspect, former MP Palitha Thewarapperuma, has since passed away.
When the case was taken up, Withanage appeared in open court. Given the absence of the complainant and the circumstances, the Magistrate ordered his discharge from the proceedings.
