Supreme Court Dismisses FR Petitions Challenging Sri Lanka–India MoUs

The Supreme Court of Sri Lanka has decided to dismiss, without hearing, two fundamental rights petitions that sought to nullify seven Memoranda of Understanding (MoUs) signed between the Governments of Sri Lanka and India.

The order was issued by a Supreme Court bench comprising Justices Achala Wengappuli and Priyantha Fernando, following a detailed review of the facts presented.

The petitions were filed by a group including Dr. Gunadasa Amarasekara and the ‘Vinivida Foundation’, challenging the legality and constitutionality of the agreements signed during Indian Prime Minister Narendra Modi’s official visit to Sri Lanka in April this year.

The seven MoUs in question span multiple sectors of strategic importance, including energy, digitalization, defence, healthcare, and development cooperation.

Despite the concerns raised by the petitioners, the Court ruled that there was insufficient merit to proceed with a hearing, thereby allowing the agreements to stand.
