The Supreme Court today, in a majority decision, ruled that the fundamental rights of citizens were violated when then Acting President Ranil Wickremesinghe ordered the forcible dispersal of ‘Aragalaya’ protestors from Galle Face Green on July 17, 2022.
The court determined that the use of Emergency Regulations under the Public Security Ordinance to remove peaceful demonstrators constituted a breach of constitutional rights The landmark ruling comes following multiple petitions filed by protestors and civil rights activists who challenged the legality of the government’s actions during the final stages of the Aragalaya movement.
The Supreme Court emphasized the importance of protecting citizens’ rights to peaceful assembly and expression, even during times of political transition or unrest.
Legal experts say the verdict sets a significant precedent in reinforcing democratic freedoms and the limits of executive power during emergency situations.
