Ten years after the complaint victim says she was not raped
A rape case that came up for hearing before Galle High Court Judge Kavindya Nanayakara, took a dramatic turn when the victim of the incident who was the first witness for the prosecution contradicted her complaint to the police and stated that she was not raped by the main suspect and that he was not known to her.
The high court judge who acquitted the accused ordered Wanduramba police to file action against the witness for giving false evidence in court. She was released on personal bail of Rs.10000.
A 54 year old man stood indicted with the rape of a 14 year old girl on May 15, 2014 , and her 49 year old mother with aiding and abetting.
The suspect had been 44 years old and the girl’s mother 39 years old at the time of the incident. The victim is today a 24 year old woman.
The victim had in her complaint to Wandurama police and the JMO Karapitiya teaching hospital had stated that his father often quarreled with her mother and one day he set fire to the house and fled from the area. She had stated that the main suspect who was her mother’s paramour found a house for them in Baddegama area and that on the night of the incident the main suspect raped her with the knowledge of her mother who looked at it and went away as if she did not notice it.
However giving evidence from the witness box in the high court she went back on this statement and stated that she did not know the first accused nor did he rape her.
Attorneys at Law Pamudi Weerasuriya, Nandasiri Galoluwa and Sisira Weerasuriya appeared for the accused.
Wanduramba police gave evidence for the prosecution.
