Legality of November 14 General Election Date Challenged in Supreme Court
The petition names several key officials as respondents, including the Attorney General, the Secretary to the President, the Chairman of the Election Commission, and its members. Herath claims that, under Section 10 of the Parliamentary Elections Act, nominations were accepted from 4th October to 11th October.
According to the Act, the election date should be between five and seven weeks from the closing of nominations, meaning the election should take place between 15th November and 29th November. Therefore, holding the election on 14th November is unlawful, the petition asserts.
The petitioner also alleges that despite attempts to inform the Chairman of the Election Commission about the issue, no corrective action was taken. Herath is requesting the Supreme Court to declare the decision unconstitutional and to issue orders for its rectification.
