Court stops arrest of ex-CCD Chief

The Court of Appeal of Sri Lanka has issued an interim injunction preventing the arrest of four police officers, including former Director of the Colombo Crimes Division and retired Senior Superintendent of Police Janak Nandana, in connection with investigations into the murder of alleged underworld figure Makandure Madush.

The order was issued by Court of Appeal Judge Priyantha Fernando after considering a petition filed by the officers who had served in the Colombo Crimes Division.

The petitioners stated that the Criminal Investigation Department is conducting an investigation into the murder and that they face the risk of being unlawfully arrested in connection with the case.

They further claimed that the investigation is being carried out under the direction of the Director of the Criminal Investigation Department, Shani Abeysekara, and could cause them serious prejudice.

Accordingly, the petitioners sought an interim order from the court preventing their arrest, as well as an order to remove Shani Abeysekara from overseeing the investigation.

After considering submissions made by President’s Counsel Ali Sabry on behalf of the petitioners, the Court of Appeal granted the interim relief and fixed the case for further hearing on May 15.

The court also directed that notices be issued to the respondents.
