Social activist Oshala Herath has filed an appeal before the Supreme Court challenging the judgment of the Appeals Court regarding State Minister Diana Gamage's parliamentary membership.
This move comes two weeks after the dismissal of Herath's initial petition by the Appeals Court. The original petition raised concerns about Diana Gamage's parliamentary seat and citizenship, asserting that she is ineligible for parliamentary membership in Sri Lanka due to holding British citizenship alongside her Sri Lankan citizenship.
In the appeal, Herath has identified State Minister Gamage and several others as respondents. Previously, his petition alleging the State Minister's disqualification was rejected by a three-member judge bench of the Appeals Court on October 31. The decision, a split 3-2 ruling, resulted in dismissal, contingent upon the payment of a fee.
Herath is now seeking a Supreme Court order to declare the Appeals Court ruling as unlawful. He aims to establish that State Minister Gamage is not qualified to retain her parliamentary membership. The case brings attention to the complex issue of dual citizenship and its implications on holding public office in Sri Lanka.
