The Court of Appeal has issued a Writ of Certiorari, overturning the government's decision to mandate retirement for public officers, including those in the nursing service, at the age of 60.
This decision is specifically applicable to officers in Grade I, Supra Grade, Special Grade, and Executive Grade within the Sri Lanka nursing service.
The Court of Appeal, presided over by a two-judge bench consisting of Justice Nissanka Bandula Karunaratne and M.A.R. Marikar, issued this order following a hearing related to a writ petition brought forward by the Rajya Seva Eksath Heda Sangamaya, Rev. Muruththettuwa Ananda Thera, and the Chief Nursing Training Officer of Colombo National Hospital.
Furthermore, the Court of Appeal has also issued a Writ of Mandamus, directing the reinstatement of all officers within the Sri Lanka nursing service, particularly those in Grade I, Supra Grade, Special Grade, and Executive Grade, who were previously subjected to compulsory retirement through a government gazette.
The petitioners were represented by President's Counsel Romesh de Silva.
